No Objections, KPU Denies Gerindra Candidate’s Claim in Deli Serdang

JAKARTA (MKRI) — The Constitutional Court (MK) held a follow-up hearing to hear responses from the Respondent and statements from the Election Supervisory Body (Bawaslu) on the Legislative Election Results Dispute (PHPU) for the Deli Serdang electoral district on Monday, May 13 2024. Case No. 207-02-02-02/PHPU.DPR-DPRD-XXII/2024 was filed by a Gerindra (Great Movement Party) DPRD (Regional Legislative Council) candidate, Mangadar Marpaung. The panel of justice consisted of Chief Justice Suhartoyo, Constitutional Justice Daniel Yusmic P. Foekh and M. Guntur Hamzah.
At this hearing, the KPU as the Respondent clarified the petitioner's claims previously made in the preliminary hearing about the shift or addition of votes to Suriani.
"Mangadar Marpaung's vote count was 6,072 votes while Suriani received 6,368 votes. The petition in question only concerns the vote count in Kutalimbaru subdistrict, where the petitioner (Mangadar Marpaung) received 149 votes. In contrast, Suriani's vote count was 4,164 votes," explained Sigit Nurhadi Nugraha, the legal counsel for the Respondent.
Sigit reported that during the plenary hearing at the Kutalimbaru subdistrict level, attended by Gerindra witnesses as per the attendance list and the Mandate Letter submitted to the PPK (subdistrict election committee) of Kutalimbaru, there were no objections related to the petitioner's claims.
Regarding the petitioner's claims, Bawaslu of Deli Serdang Regency has ruled on the alleged administrative election violation, stating that the accused was not proven to have legally and convincingly committed any act violating the procedures, or mechanisms at the election stages as per statutory laws and regulations.
Bawaslu reported that during the regency-level recapitulation in Deli Serdang, no objections were raised by Gerindra witnesses on the recapitulation in Kutalimbaru subdistrict for the Deli Serdang Regency DPRD positions in Electoral District 4. The Gerindra witnesses did not raise objections and signed the Model C-Results copy and D-Results of Deli Serdang Regency forms.
"There was one election violation reported due to discrepancies between the C Results Copy for the Regency/City DPRD and the D Results of Kutalimbaru Subdistrict. Bawaslu of Deli Serdang Regency has conducted an initial review and concluded that it meets the formal and material requirements with regulations governing the settlement of election administration results," clarified Johan Alamsyah Nasution.
He stated that there were no special incidents or objections from Gerindra Party witnesses during the recapitulation at the Regency/City level related to the petitioner's claims.
Previously, in the preliminary hearing, the petitioner essentially claimed a shift or change in the vote count of the Gerindra Party and its DPRD candidates for Deli Serdang Regency in the 2024 General Election vote count recapitulation in Kutalimbaru Subdistrict.
