JAKARTA (MKRI) - The General Elections Commission (KPU) stated that the petition from the National Awakening Party (PKN) is obscure or obscuur libel between the arguments presented and the data used as evidence. This was stated by the KPU as the Respondent in the case of the 2024 Election Results Dispute (PHPU) filed by the PKN at the Constitutional Court (MK).
For example, according to the Petitioner, there was a deduction of PKN votes during the recapitulation in South Yapen District amounting to 2,698 votes. The Petitioner claimed to have acquired 3,474 votes, but the KPU stipulated that PKN received 776 votes. Meanwhile, there was an addition of votes for the United Indonesia Party (Perindo) by 1,643 votes. The Petitioner mentioned that Perindo should have acquired 1,254 votes instead of the 2,897 votes as stipulated by the KPU.
However, according to the KPU, there is a discrepancy in votes between the deduction of PKN votes by 2,698 votes and the addition of Perindo votes by 1,643. The remaining transferred votes are not explained by the Petitioner.
"The transferred votes are not the same, meaning there is a remaining difference in votes. Initially, the difference was 2,698, but with 1,643 transferred, it means there are remaining votes, and it's not explained where they went," said the Respondent’s legal counsel, MHD. Abduh Saf, in the Panel Hearing Room of Building 2 of the Court, Central Jakarta on Wednesday (8/5/2024). The Case Number 167-01-09-33/PHPU.DPR-DPRD-XXII/2024 was held in Panel 2 presided over by Constitutional Deputy Chief Justice Saldi Isra, accompanied by Constitutional Justice Ridwan Mansyur and Constitutional Justice Arsul Sani.
The KPU stated that the Petitioner's petition is also obscure because it alleges a deduction of PKN votes and an addition of votes for the Perindo in South Yapen District. Because the explanation and tables presented in the petition are irrelevant.
Furthermore, the KPU mentioned that PKN acquired 776 votes in South Yapen District from the total valid votes of 25,306 votes. However, as stated by the Petitioner, if the vote acquisition is totaled in South Yapen District, it is 26,361. According to the KPU, the Petitioner's petition becomes obscure because it is not based on relevant data.

Additionally, PKN (Petitioner) in its petitum requested the Court to annul KPU Decree No. 360 of 2024 on the 2024 Legislative Election Results Stipulation announced nationally on Wednesday, March 20, 2024, at 10:19 PM WIB across Papua Electoral District 6 for the filling of members of the Papua Provincial DPRD and Yapen Islands Electoral District 1 for the filling of members of the Yapen Islands District DPRD. The Petitioner also requested the Court to stipulate the correct vote acquisition according to the Petitioner for the filling of membership in the Papua Provincial DPRD District 6: PKN 3,474 votes and for the filling of membership in the Yapen Islands District DPRD 1, especially in South Yapen District PKN as 916 votes.
