JAKARTA, MKRI – The Constitutional Court (MK) held a preliminary hearing over the 2024 DPR/DPRD (House of Representatives/Regional Legislative Council) election results on Friday, May 3, 2024. The hearing was presided over by the Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.
The hearing took place at Panel 3 of the Court for examining case No. 166-01-01-26/PHPU.DPR-DPRD-XXII/2024. The petition was filed by the National Awakening Party (PKB), which was represented by H. A. Muhaimin Iskandar as Chairman and Hasanuddin Wahid as Secretary General. The hearing is related to the DPRD election for Sigi Regency, Electoral District (Dapil) Sigi 5, with the petition object on General Election Commission (KPU) Decree No. 360 of 2024.
At the hearing, the Petitioner argued that there was a vote margin between the Petitioner and the Indonesian Democratic Party of Struggle (PDI-P) based on the Petitioner’s and the Respondent's versions. The Petitioner claimed that he should receive 2,190 votes, but the Respondent certified 2,181 votes. Meanwhile, PDIP should receive 2,189 votes, but the Respondent certified 2,190 votes.
According to the Petitioner, the vote margin occurred due to a reduction in his votes at polling station (TPS) 3 of Boya Baliase Village, Marawola Subdistrict, Sigi Regency, which previously reached 20 votes, but turned into 19 votes. The vote loss was caused by administrative errors in data entry by the subdistrict election committee (PPK) of Marawola Subdistrict, Sigi Regency. This can be seen in the C-Result, C-Copy, and D-Result documents.
"The Petitioner’s vote loss at TPS 3 Boya Baliase Village, Marawola Subdistrict, Sigi Regency, which was previously 20 votes, but turned into 19 votes. The vote loss was caused by administrative errors in data entry by the PPK of Marawola District, Sigi Regency," said Iqbal Baharudin as the Petitioner's legal counsel.
In addition, the Petitioner also asserted that the vote margin was caused by the PDIP’s vote inflation which was carried out by the Respondent. Previously, PDIP received 20 to 29 votes at TPS 5 Uwemanje Village, Kinovaro Subdistrict, Sigi Regency. The vote inflation was also due to administrative errors in data entry by the PPK of Kinovaro Subdistrict, Sigi Regency, which were also seen in the C-Copy and D-Result documents.

In his petition, the Petitioner requests the Court to annul the KPU Decree No. 360 of 2024 on the matter. The Petitioner also requests the Court to certify the correct vote acquisition results according to the Petitioner version.(*)
