JAKARTA (MKRI) — Abubakar Abdullah, candidate for the Provincial Legislative Council (DPRD) from the Prosperous Justice Party (PKS), filed a petition on the 2024 Legislative Election Results Dispute (PHPU) for Members of the House of Representatives (DPR RI), Provincial Legislative Councils (DPRD Province) , and Regency/City Legislative Councils (DPRD Regency) to the Constitutional Court (MK). The the Preliminary Hearing for Case No 21-02-08-18/PHPU.DPR-DPRD-XXII/2024 on Panel 2 was presided over by Deputy Chief Justice Saldi Isra along with Constitutional Justices Ridwan Mansyur and Arsul Sani on Thursday, May 2, 2024.
Through their legal counsel, Benny Ridho, the Petitioner asked so the Constitutional Court (MK) General Elections Commission (KPU) Decision No 360 of 2024 on the certification of the 2024 legislative election results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationally on March 20, 2024 at 22:19 WIB for West Lombok 2.
As a result of that decision, the Petitioner's vote tally influenced the allocation of seats for members in the Regional Representative Council (DPRD) of West Lombok for the Petitioner. This is due to several issues regarding the addition and subtraction of votes for PKS party candidates. Specifically, the vote tally for PKS party candidate Number 2, Hadran Farizal, according to the Respondent, was 3,966, while according to the Petitioner, it was 3,024, resulting in an addition of 942 votes. For PKS party candidate Number 7, L. Amrun, according to the Respondent, received 41 votes, whereas according to the Petitioner, it was 133 votes, resulting in a subtraction of 92 votes. As for PKS candidate Number 8, Badrun Tammam, according to the Respondent, received 126 votes, whereas according to the Petitioner, it was 976 votes, resulting in a subtraction of 850 votes.
"This occurred in 82 polling stations across the Sekotong and Lembar districts. Legal actions have been pursued in each electoral district concerning the discrepancies in the vote tally for the PKS candidates. However, these efforts failed to reconcile the vote tally with the Copy of the Tally Sheet at the polling station level," remarked Benny from the Panel Hearing Room, Building 2, Constitutional Court (MK).
Regarding this matter, the Petitioner requests that the Court annul a decision by determining the correct vote count as the Petitioner version in the filling of Candidate Members of the DPRD Regional West Lombok 2 from PKS.
