PAS Candidate Dispute in East Aceh 2, Request for Vote Recount

JAKARTA (MKRI) —- The Constitutional Court (MK) held the preliminary hearing on the election results dispute (PHPU) of the Aceh Regency/City Legislative Council (DPRK) in the Electoral District (Dapil) East Aceh 2 for Case No. 121-02-22-01/PHPU.DPR-DPRD-XXII/2024 in Panel 3 Courtroom, Tuesday morning (4/30/2024). The hearing was presided over by the Constitutional Justice Arief Hidayat, Anwar Usman, and Enny Nurbaningsih. The petitioner was identified as Subki Tgk. Jek, a candidate for the DPRK in Dapil East Aceh 2 from the Prosperous Justice Party (PAS) Aceh.
Through his legal counsel Maya Indrasari, the Petitioner disclosed a discrepancy in the vote count results between their claims and those stipulated by the Respondent (General Elections Commission (KPU)). Based on the comparison of Form C Result - DPRK Results and Form D Result - Sub-district DPRK Resulted from two Sub-districts in Dapil East Aceh 2, specifically Peureulak Timur and Ranlo Peureulak, there was a vote margin favoring Candidate Muhammad Daud of the PAS number 5 by 77 votes. This addition of votes caused Candidate no. 1 (Petitioner) of losing a seat in the DPRK.
"Candidate no. 5 from PAS engaged in vote inflation in two Sub-districts, Peureulak Timur and Ranlo Peureulak," stated Maya Indrasari.
"According to the Petitioner, the additional votes to Candidate no. 5 from the PAS in Form D Result - Sub-district DPRK did not match the Form C Resulted from DPRK copy.
In accordance with the presented statement, the Petitioner requested the Court to order the KPU to recount the ballot in Peureulak Timur and Ranlo Peureulak Sub-districts in Dapil East Aceh 2 or to stipulate the correct vote count result as deemed correct by the Petitioner for the membership of the DPRK in Dapil East Aceh 2.
