JAKARTA (MKRI) — The Constitutional Court (MK) held the preliminary hearing for dispute over the results of the 2024 election of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) of the electoral district (dapil) of West Java 4 Province on Tuesday, April 30, 2024 in the plenary courtroom. The case No. 52-01-03-12/PHPU.DPR-DPRD-XXII/2024 was petitioned by the Indonesian Democratic Party of Struggle (PDI-P).
At the hearing chaired by Chief Justice Suhartoyo, legal counsel Roy Jansen stressed that the Petitioner was a participant in the 2024 election as determined by the General Elections Commission (KPU) (Respondent) in the KPU Decree No. 519 of 2022 on the determination of the order number of political parties participating in the 2024 election of the DPR (House of Representatives) and Provincial and Regency/City DPRD (Regional Legislative Council) and the local Aceh parties. As a contesting political party, the Petitioner had the right to join the legislative election, including the DPRD election of the electoral district of West Java IV.
As an election participant, the Petitioner has followed all stages of voting, vote count, and tiered calculation and recapitulation starting at the polling stations (TPS), subdistrict election committee (PPK) at the subdistrict, regency, provincial, and national levels.
“In the process of tiered recapitulation, the Petitioner through its witnesses assigned to each level of recapitulation found irregularities and differences between C-Result forms at the polling stations, the D-Result forms at PPK, and the D-Result forms at the regency/city level up to the D-Result forms at the province national levels,” Roy Said.
Because of this, the Petitioner through its assigned witness filed an objection to the above issue. In addition to objecting to the tiered tally as mentioned, the Petitioner also filed a request for a revote citing alleged administrative violations of vote counting and recapitulation carried out by the Respondent to the Sukabumi Regency Bawaslu (Election Supervisory Body).
In addition to filing those objections, the Petitioner has also submitted a request for inspection and recommendation over alleged administrative violations of vote counting and recapitulation committed by the Respondent to the West Java Provincial Bawaslu. Until this petition was submitted, Bawaslu had not yet decided on some of these matters.
Then, Roy continued, the Petitioner had also requested that ballot boxes be opened in the regency recapitulation process for all subdistricts in Sukabumi Regency, but the Respondent did not respond. He said the Petitioner juxtaposed and explained the difference in vote acquisition with evidence only in the petitioned electoral district IV, especially in Sukabumi Regency, where PDI-P’s votes on the C-Result forms amounted to 113,426 and in the subdistrict D-Result forms, the regency D-Result forms, as many as 108,355 in the of the provincial D-result forms, and 108,355 in the national D-result forms.
“Thus, PDI-P’s votes decreased by 5,071 votes. As for the National Mandate Party (PAN), in the C-result forms it had 106,848 votes, and in the subdistrict and regency/city D-Result forms, provincial D-Result forms, finally PAN’s votes in the national results amounted to 112,426 votes. As such, when compared to the C-result form per polling station, PAN’s votes starting from the subdistrict D-result forms increased by 5,581 votes,” Roy said.
Vote Inflation Benefitting PAN
The Petitioner also argued that the political party whose votes increased significantly in Sukabumi is PAN. In the recapitulation of the C-result forms, PAN only obtained 106,848 votes, but in the tally it increased to 112,426 votes. It can be concluded that PAN’s votes have experienced inflation of 5,581 votes because there was an inflation of votes, so PAN’s votes should be reduced in the West Java electoral district IV as many as 106,848 votes.
The alleged inflation of PAN’s votes in West Java electoral district IV has disadvantaged PDI-P. It alleges a reduction by 13 votes for it at TPS 17 of Titisan Village, Sukalarang Subdistrict, Sukabumi Regency.
In addition, the Petitioner also alleges an increase in votes for PAN in 9 polling stations in Nyalindung Village, Bojongsari Village, Neglasari Village, Bojongkalong Village, Cijangkar Village, Mekarsari Village, Wangunreja Village, Sukamaju Village, Cisitu Village, and Kertaangsana Village of Nyalindung Subdistrict, Sukabumi Regency by 510 votes.
For the following reason, the Petitioner requests the Court to determine the correct results of the 2024 DPR election in West Java electoral district IV based on their C-Copies with a total of 111,426 votes for the Petitioner and 106,848 for PAN.
