Petitioners Intimidate Against Supervisory Committee
The witnesses of the Respondent, the National Election Commission of South Buru District and Related Parties, regional head candidate sequence number 6, Tagob Solissa and Ayub Saleki, said the testimony of the witness' petition were false. "Implementation of voting from the beginning to the end running according to the principles of direct, general, free, confidential, honest and fair,"said Gawi Mahtelu, the Respondent's witnesses, in case No. 51/PHPU.D-IX/2011, Friday (13 / 5) morning in the courtroom of the Constitutional Court.
According to Gawi, during the implementation of voting at polling stations (TPS) 2, Kampung Baru Village, there was no protest or commotion that happened. "There is no objection (from witnesses)," he said. As a proof, witness minutes signed by the applicant at the polling stations. Gawi also denied the expulsion of Petitioners' witnesses.
The testimony was in fact justified by one of the witnesses also mandate candidate number 1, Anthony Lesnussa and Hadji Ali (Applicant) itself, namely Mursalim Boy. In his testimony, witness statements Mursalim said that the Petitioner is not true. "(Testimony), it was a lie sir," he told Judge of the Constitutional Assembly. In the trial, Mursalim is presented by the Related Parties. For information, the witness is a witness to the official mandate of each pair of candidates whose task was to watch the process of voting in every polling station. Typically, witnesses mandate amounted to 2 people per polling station.
In the meantime, to answer the argument of not granting voting rights to 108 people in the village of Lena TPS 1, the Respondent has presented the Chairman of the Organizing Group Sounds polling stations 1, Bapang Letimuni. Letimuni explains, a group of people are not allowed to vote because no computer on the Voters List (DPT) and does not have an invitation to vote.
Even so, he confirmed that 108 people can vote on the election of president / vice president of the past or even the first round of the General Election. However, he reasoned, and then there is the policy of his party so that they can vote. But now, he was forbidden to take the same policy. "There should be no policy," he mimicked. He also admitted that a group of people is indeed local residents. "(They) have a KTP (identity cards) Lena," he explained.
While other Related witness, disputed the argument about the existence of money politics. One witness, Yakobis Seleki, said that he was right there to give money, but the gift was in order to assist it and use his personal money. According to him, he gave no family relationship with that person. He stated, he was never involved as a partner success of any team because he is a Civil Servant (PNS).
Intimidated Supervisory Committee
To strengthen the rebuttal, the Respondent also presents Yamlea Ibrahim, one of the Election Supervisory Committee Member. In essence, Ibrahim explained that it did not have received one report related to fraud or any violation in District Leksula. While in the village of Kampung Baru, it is receiving reports from team mate number 1 (Applicant).Violations were reported in the form of intimidation of witnesses and the voters who vote more than once. "One member KPPS against witnesses," he said.
However, Ibrahim continued, after the Supervisory Committee conduct a field investigation, by asking directly to the polling station officials and Field Supervisory Committee, it seems that the report was not proven.
